License Agreement

This End User License Agreement (EULA) is a legal agreement between YOU (AN INDIVIDUAL PERSON OR THE COMPANY YOU REPRESENT) as the LICENSEE of the SOFTWARE and Data Model Pack as the OWNER and LICENSOR of the SOFTWARE.

The SOFTWARE means the computer software, associated documentation and any materials made available by Data Model Pack.

THE USE OF THE SOFTWARE LICENSED TO YOU IS SUBJECT TO THE TERMS AND CONDITIONS OF THIS SOFTWARE LICENSE AGREEMENT. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUNDED BY ALL OF THE TERMS AND CONDITIONS OF THIS SOFTWARE LICENSE AGREEMENT.

This agreement specifies your rights to the SOFTWARE. Any rights not expressly granted herein are reserved by Data Model Pack.

1. Limited License Grant

We offer two types of licenses:

  1. A Standard License for the Standard subscription
  2. A Professional License for the Professional subscription

A unique License Key is generated for YOU (LICENSEE) when you purchase a subscription. You can see your License Key in your order receipt email.

An active License Key grants you access to the SOFTWARE. You can use the License Key to sign in to your Data Model Pack account.

The License Key will remain active as long as the subscription is active, and it will only expire when the subscription expires. A subscription will only expire if it has been canceled or if payment fails.

1.1 Standard License

Data Model Pack grants YOU (LICENSEE) a personal, non-exclusive, non-transferable, limited, revocable license to access, install and use Data Model Pack SOFTWARE.

The LICENSEE must not redistribute the SOFTWARE in whole or in part, either separately or included with a product.

The License Key will remain active as long as the subscription is active, and it will only expire when the subscription expires. A subscription will only expire if it has been canceled or if payment fails.

1.2 Professional License

Data Model Pack grants YOU (LICENSEE) a personal, non-exclusive, non-transferable, limited, revocable license to access, install and use Data Model Pack SOFTWARE.

The LICENSEE must not redistribute the SOFTWARE in whole or in part, either separately or included with a product.

The License Key will remain active as long as the subscription is active, and it will only expire when the subscription expires. A subscription will only expire if it has been canceled or if payment fails.

2. Restrictions

The SOFTWARE is confidential copyrighted information of Data Model Pack, and Data Model Pack retains title to all copies. SOFTWARE may not be leased, rented, transferred, distributed, assigned, or sublicensed, in whole or in part. The SOFTWARE contains valuable trade secrets. The LICENSEE promises not to extract any information or concepts from it as part of an effort to compete with the LICENSOR, nor to assist anyone else in such an effort. The LICENSEE agrees not to remove, modify, delete or destroy any proprietary right notices of Data Model Pack, including copyright notices, in the SOFTWARE.

3. Disclaimer of Warranty

The SOFTWARE and documentation are provided "AS IS", WITH NO WARRANTIES WHATSOEVER. ALL EXPRESS OR IMPLIED REPRESENTATIONS AND WARRANTIES ARE HEREBY EXCLUDED. THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH THE LICENSEE. THERE IS NO WARRANTY THE DOCUMENTATION, Data Model Pack's EFFORTS OR THE LICENSED SOFTWARE WILL FULFILL ANY OF LICENSEE'S PARTICULAR PURPOSES OR NEEDS. IF THESE WARRANTIES ARE UNENFORCEABLE UNDER APPLICABLE LAW, THEN Data Model Pack DISCLAIMS SUCH WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY SUCH APPLICABLE LAW. In all cases, the total aggregate liability of Data Model Pack under or in connection with this agreement or the use of the SOFTWARE shall be limited to the subscription fee for the current billing period.

4. Limitation of Liability

Data Model Pack AND ITS LICENSORS SHALL NOT BE LIABLE FOR ANY DAMAGES SUFFERED BY THE LICENSEE OR ANY THIRD PARTY AS A RESULT OF USING OR DISTRIBUTING SOFTWARE. IN NO EVENT WILL Data Model Pack OR ITS LICENSORS BE LIABLE FOR ANY LOST REVENUE, PROFIT OR DATA, OR FOR DIRECT, INDIRECT, EXEMPLARY, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF Data Model Pack HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5. Termination

The LICENSEE may cancel their subscription at any time. Cancellation will terminate this License, stop future recurring payments, and Data Model Pack shall have no obligation to refund any fees already paid. This License will terminate immediately without notice from Data Model Pack if the LICENSEE fails to comply with any provision of this License. Data Model Pack reserves all rights to terminate this License.
